Condition

By entering www.gameskart.com.au, you are accepting and agreeing to the Terms and Conditions of Use described below, and your use of such sites is subject at all times, to the Terms and Conditions of Use below. Games Kart reserves the right to change the Terms and Conditions of Use at any time. These changes shall be effective when posted. You are responsible for reviewing these Terms and Conditions of Use and your continued use of the Games Kart web site constitutes your acceptance of the Terms and Conditions of Use contained herein.

Products

Photographs are for illustrative purposes only and may not exactly match the product itself. Products are on a first come first server basis, we can not be held responsible for items that are out of stock at time of making your order/s. Stock may be withdrawn or discontinued. We shall make every effort to update the website at all times, but you understand and acknowledge that we are not liable to you for any failure or delay to fulfill an order due to products being out of stock, or discontinued.

Orders

Once an order has been placed by you and accepted by us you have no right to cancel the order, except at our discretion in exceptional circumstances. Once we have dispatched the products we are unable to cancel any orders.

Payment

Payment for the price of the products shall be due in Australian Dollars at the time of the order.

You can pay with most major credit & debit cards via Paypal. Payment must be due at the time of the order using this method.

Bank Deposit / Internet Bank transfer is also accepted. Goods will not be posted until funds have cleared into our bank account.

Delivery

The Delivery Date specified by the Seller is an estimate only. Time for delivery shall not be of the essence of the Contract. Please allow 10 working days for delivery before contacting us.

Subject to the other provisions contained in these terms and conditions, we shall not be liable for any direct, indirect or consequential loss (all three terms which include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar losses), costs, damages or expenses caused directly or indirectly by any delay in the delivery of the products (even if caused by our negligence).

If for any reason you or the person at the delivery address refuses to accept delivery of the products, all risk in the products shall pass to you and we may, at our discretion, charge for return of the products to us, a storage fee and a redelivery fee to another address nominated by you.

Warranty

We shall only extend the benefit of the manufacturer’s warranty to you, and do not separately warranty the products ourselves.

In the event of the product requiring replacement or repair under the warranty, you must contact the manufacturer directly.

Price

The pricing of items is subject to change, we can not be held responsible for any loss incurred from our price changes.

Returns & Refunds

In the event that any order is incorrect, it must be notified to us within 7 days after delivery.

If any products are faulty or defective, it must be notified to us within 7 days after delivery. If we cannot resolve the fault with you by email then the full product must be returned to us within the next 7 days. We test every single return, if a returned disc(s) or hardware is found not to be faulty we will return the item(s) to you.

With console games we advise you to check the disc on another console of the same type before before contacting us. We cannot be responsible for incompatibilities caused by machines that have been modified to disable regional encoding.

With PC games and hardware we recommend you try the discs or hardware on another machine. Also please check the publishers/developers web site(s) for further support as sometimes there can be a patch and message board with solutions for common problems.  We can provide you with some basic PC technical support to help you to get the game working on your machine, but with the huge number and variations in PC configurations we cannot solve all issues that may arise (NB: this does not make the game disc faulty)

At our own discretion, we shall replace or repair the products free of charge and redeliver them at our own cost, or shall provide a refund or the price paid by you. In the event of replacement of any products, the products returned to us shall become our property.

If we elect to refund you rather than provide a replacement or repair for faulty or defective products, or we are unable to replace any faulty or defective product, the products must be returned to us, at our cost, and shall become our property.
